Using the Opus Arte website indicates that you accept these terms, conditions and disclaimers regardless of whether or not you choose to register with us or order from us.

If you do not accept these terms, please do not use the website or any of its services.

You must register your details with us in order to receive the download and streaming service. We may accept or reject your registration at our sole discretion.

An application to open a customer account can only be made by users over the age of 18 years or such other age as shall constitute the age of majority or the age at which an individual may alone enter into a legal binding contract in the jurisdiction in which the account is to be opened. 1.) General

We may amend these terms and conditions from time to time, and place the new version on the website. All purchases from the date that the amended terms are placed on our website onwards will be governed by those new terms. You are advised to read (and are responsible for reading) all information on this website fully. Opus Arte reserves the right to modify, suspend, or discontinue the Service (or any part or content thereof) at any time and Opus Arte will not be liable. Opus Arte may provide links to certain third party Web sites. You acknowledge and agree that Opus Arte is not responsible for examining or evaluating the content or accuracy of any such third-party material or Web sites. Opus Arte does not warrant or endorse and does not assume and will not have any liability or responsibility for any third-party materials or Web sites, or for any other materials, products, or services of third parties. These terms and conditions are subject to the laws and exclusive jurisdiction of the United Kingdom. Opus Arte may at any time at its sole discretion change, add or remove any part of these Terms of Use by posting amended Terms on the Site. If any modification is unacceptable to the End User, the End User must stop using the Site. Unless otherwise specifically set forth in the amended Terms, all changes will be effective upon the date the amended Terms are published on the Site. End Users continued use of the Site following the effective date will constitute binding acceptance of the Terms and agreement to be bound by the changes specified therein. It is the responsibility of the End User to frequently check and review the terms of this agreement so as to be aware of the most current terms of this agreement. If any new content, products or services become available, they will be considered a part of the Site and the End Users use of them will be governed by the terms of this Agreement. In the event of major changes to the Term and Conditions, End Users will be notified.

If you do not wish to accept the new Terms and Conditions you should not continue to use the Opus Arte Site and the Online Store. If you continue to use the Opus Arte Site after the date on which the change comes into effect, your use of the Opus Arte Site indicates your agreement to be bound by the new Terms and Conditions.

You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:

  • any claim by any third party that the use of the Opus Arte Site by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;
  • any claim by any third party that the use of the Opus Arte Site by you infringes that third party's copyright or other intellectual property rights of whatever nature; and
  • any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the Opus Arte Site by you.

2.) Opus Arte Technology and Use

(i) Availability of the Opus Arte Site

Although Opus Arte aims to offer you the best service possible, Opus Arte makes no promise that the services at the Opus Arte Site will meet your requirements. Opus Arte cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to customer services and we will attempt to correct the fault as soon as we reasonably can.

Your access to the Opus Arte Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Opus Arte will attempt to restore the service as soon as it reasonably can.

(ii) System Requirements

Use of the Site may require additional computer hardware, Internet access and certain software any or all of which may require the End User to make additional expenditures or pay fees. The use of the Site may require obtaining updates or upgrades from time to time of Opus Arte software and third party's proprietary software. As use of the Site involves hardware, software, and Internet access, End Users ability to use the Service may be affected by the performance of these factors. End Users acknowledges and agrees that system requirements may be changed from time to time and it is the responsibility of the End User to ensure that any changes necessary to enable the Site to operate effectively and efficiently are made.

The services provided by the Opus Arte Site do not include the provision of computer or other necessary equipment to access the Opus Arte Site. To use the Opus Arte site you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.

(iii) Technological and Use Limitations

Opus Arte will take what it believes to be reasonably commercial efforts to keep the Site operational. However, certain technical difficulties, routine site maintenance/upgrades and other events outside the control of Opus Arte may, from time to time, result in temporary service interruptions. Opus Arte also reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, functions of the Site with or without notice. You agree that Opus Arte shall not be liable to you or to any third party for any of the direct or indirect consequences of any modification, suspension, discontinuance of or interruption to the Service.

As the Service is designed for personal sampling and use, you are not allowed to use any automated system for the selection or downloading of Content. Opus Arte reserves the right to immediately and permanently terminate your access to the Service if Opus Arte believes, correctly or incorrectly, that you are violating such limitation. In the event that End User is using an automated system to download Content, the End User shall be responsible to Opus Arte for any losses suffered by Opus Arte resulting either directly or indirectly from the breach of this Agreement.

End User will not directly or indirectly (by allowing others to use the End Users access to the Site): (a) attempt to or actually disrupt, impair or interfere with, alter or modify the Site or any information, data or materials posted and/or displayed by Opus Arte or anyone else; (b) act in a way that affects or reflects negatively on Opus Arte, the Site or anyone else; (c) collect or attempt to collect any information from others including, without limitation, personally identifiable information, without such party's prior consent.

End User is prohibited from violating or attempting to violate the security of the Site. Violations of system or network security or this Agreement may result in civil or criminal liability. Opus Arte has the right to investigate occurrences, which may involve such violations and may involve, provide information to and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

3.) Information Collected and Used

At this site you can purchase digital products, enter contests, submit reviews and ratings or otherwise express an opinion, subscribe to one of our services such as our online newsletters, or participate in one of our online forums or communities. The types of information that may be collected at these pages include: your name, e-mail address, postal address, and telephone number. We request these details in order to provide our services or product to you, prevent fraud, and to respond to any queries you may have.

(i) Your Information

You agree to provide accurate, current, and complete information required to register with the Service and at other points as may be required in the course of using the Service ("Registration Data"). You further agree to maintain and update your Registration Data as required to keep it accurate, current, and complete. Opus Arte may terminate your rights to any or all of the Service if any information you provide is false, inaccurate or incomplete. You agree that Opus Arte may store and use the Registration Data you provide for use in maintaining your accounts. Opus Arte does not store any credit or debit card details.

(ii) Outside Parties

We may share information about visitors to this site in aggregate with third parties including advertisers, business partners, and sponsors, to analyse site usage and manage and improve our business relationships. Please be assured that before we share such information with any third parties, the information will be made anonymous so that your identity is protected. We may share personal information with third parties to administer and process your requests (e.g., when you order a product or service we may share your details with third party financial institutions to process payment for your order). We may also share your details with third parties to obtain professional advice, such as auditors. We may on occasion combine information that we receive online with outside records to enhance our ability to notify you of our products and services that we think will be of interest to you.

As a convenience to Opus Arte customers, the Opus Arte Site includes links to other web sites or material which are beyond its control. Opus Arte is not responsible for content on the Internet or World Wide Web pages on the Opus Arte site or any other site outside the Opus Arte Site.

(iii) Cookies

When you first visit this site we send a "cookie" to your computer primarily to enhance your online experience. "Cookies" are files that can identify you as a unique customer and may store your personal preferences as well as technical information such as the type of browser you are using. On their own cookies do not contain or reveal any personal information. However, if you choose to furnish the site with personally identifiable information, this information may be linked to the data stored in the cookies. We use cookies to personalise your visit (e.g. to recognise you by name when you return to this site) and to track customer trends and patterns. This helps us improve the design and content of our site for visitors and assists us in our marketing initiatives. Credit and Debit cards are debited before any digital product is downloaded unless the downloads are of a free promotional offer by digital store. All prices include sales taxes (where applicable) unless otherwise stated. Every purchase you make shall be deemed performed in the UK. In entering into this Agreement End User agrees to pay the specific fees, costs or other charges resulting from the End Users use of the Site. The End User is also solely responsible for paying any taxes, duties, government levies or other charges imposed by a taxing or other regulatory authority relating to the use of the Site. UK law shall govern every aspect of contractual agreement concerning purchases made from this web site. Although this site is accessible worldwide, it is possible that certain titles shown may not be available in every country.

All fees and charges are non-refundable.

Payment must be made by any major credit card accepted by Opus Arte or any other methods of payment as Opus Arte may accept from time to time. If Opus Arte does not receive payment from the credit card issuer, End User agrees to pay all amounts due upon demand by Opus Arte. You, and not Opus Arte, are responsible for paying any amounts billed to your credit card whether by you or by a third party (even if not authorised by you) and any reasonable attorney's fees and costs incurred by Opus Arte to collect any past due amounts.

Use of the Site includes the ability to enter into agreements and/or to make purchases electronically. You acknowledge that your electronic submissions constitute your agreement and intent to be bound by and to pay for such agreements and purchases. Your agreement and intent to be bound by electronic submissions applies to all records relating to all transactions you enter into on this site, including notices of cancellation, policies, contracts, and applications.

Unless you notify Opus Arte of any discrepancies in transactions within fourteen (14) days after they are first reported to you, such transactions will be deemed accepted by End User for all purposes, including resolution of inquiries made by your card issuer. End User releases Opus Arte from all liabilities and claim of loss resulting from any error or discrepancy that is not reported to Opus Arte within fourteen (14) days of its first appearance.

Opus Arte reserves the right, at any time, to change its fees and billing methods, including the addition of supplemental fees or separate charges for content, or services provided by Opus Arte, effective immediately upon Opus Arte providing notice of the change in accordance with this agreement. If any such change is unacceptable to the End User, the End User may terminate the Agreement immediately and at any time in accordance with this Agreement. Your continued use of the site following the effective date of a change to such fees and billing methods shall constitute your acceptance of such change.

Once a Product is purchased and delivered to the End User, it is the End User's responsibility not to lose, destroy, or damage the Product, and Opus Arte shall be without liability to the End User in the event of any loss, destruction, or damage.

On occasion, technical problems may delay or prevent delivery of your Product. Your exclusive and sole remedy with respect to Product that is not delivered within a reasonable period will be either replacement of such Product, or refund of the purchase price paid for such Product, as determined by Opus Arte.

It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law.

(v) User Accounts and Security Account and Password.

As a registered user of the Service, you may receive or establish an account ("Account"). You are solely responsible for maintaining the confidentiality and security of your Account. You should not reveal your Account information to anyone else or use anyone else's Account. You are entirely responsible for all activities that occur on or through your Account, and you agree to immediately notify Opus Arte of any unauthorised use of your Account or any other breach of security. Opus Arte shall not be responsible for any losses arising out of the unauthorised use of your Account which is not due to the negligence of Opus Arte.

Before accessing the services offered on the Site the End User shall open a customer account (the "Account"). The End User agrees to provide true, accurate, current and complete information as prompted by the registration process (the "Registration Data"). The End User further agrees that, in providing the Registration Data, the End User will not knowingly omit or misrepresent any material facts or information and will promptly enter corrected or updated Registration Data as required to keep such data accurate, current, and complete.

The End User consents and authorizes Opus Arte to verify the Registration Data.

End User Agrees that Opus Arte may store and use the Registration Data provided (including credit card information) to facilitate use and management of the End User Account and to facilitate billing direct to End Users credit card.

The End User is responsible for maintaining the confidentiality of Account information, including password, and for all activity that occurs in or from that Account. End User agrees to notify Opus Arte immediately of any unauthorized use of the Account or password, or any other breach of security. End User may be held liable for losses incurred by Opus Arte or any other user of the Site due to someone else using End Users password or customer account. End User agrees not to use anyone else's password or customer account at any time.

By establishing an Account, End Users grant permission for Opus Arte to contact End User for any reason (including but not limited to the distribution of promotional materials for Opus Arte and other products) at the email address specified by the End User at registration or at such address as shall be advised by the End User from time to time.

When you register to use the Opus Arte Site you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us by contacting customer services immediately.

If Opus Arte has reason to believe that there is likely to be a breach of security or misuse of the Opus Arte Site, we may require you to change your password or we may suspend your account.

4.) Content

(i) Opus Arte Content

Opus Arte accepts no liability for any loss or damage to content once it has been downloaded from our store. Any further use of the content once downloaded is entirely the responsibility of the customer, who, by registering with Opus Arte, expressly agrees to abide by all relevant copyright laws with respect to the content downloaded. You shall be authorised to use the Products only for personal, non-commercial use, and not for redistribution, transfer, assignment or sublicense, to the extent permitted by law.

(ii) User-Generated Content

Opus Arte may offer interactive features that allow you to, among other things, submit or post information, materials or links to third party content on areas of the Service accessible and viewable by other users of the Service and the public. You represent and agree that your possible participation in any such activities and any use by you of such features, including any information, materials or links submitted or posted by you, shall be your sole responsibility, shall not infringe or violate the rights of any other party or violate any laws, contribute to or encourage infringing or otherwise unlawful conduct, or otherwise be obscene, and that you have obtained all necessary rights, licences or clearances. You further agree to provide accurate and complete information in connection with your submission or posting of any information or materials on the Service. Moreover, you hereby grant Opus Arte a worldwide, royalty-free, non-exclusive licence to use such materials as part of the Service, and in relation to products, without any compensation or obligation to you. Opus Arte reserves the right not to post or publish any materials, and to delete, remove or edit any material, at any time in its sole discretion without notice or liability Opus Arte has the right, but not the obligation, to monitor any information and materials submitted or posted by you or otherwise available on the Service, to investigate any reported or apparent violation of this Agreement, and to take any action that Opus Arte in its sole discretion deems appropriate. We advise you not to post or in any way reveal any of your personal details on the Community Sites (for example, your address and telephone number).

You may not use the Community Sites for any of the following purposes:

  1. disseminating any unlawful, harassing, libellous, defamatory, racially offensive, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material;
  2. transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice;
  3. transmitting material containing any form of advertising or promotion for goods and services, junk mail, chain letters or "spam";
  4. gaining unauthorised access to other computer systems;
  5. interfering with any other person's use or enjoyment of the Community Sites;
  6. making or transmitting or storing electronic copies of materials protected by copyright without the permission of the owner;

Opus Arte does not control the content placed on the Community Sites. However, Opus Arte reserves the right to refuse to post material, to remove material posted on the Community Sites and to contact you in the event that there are concerns about the content you have added to a Community Site. Opus Arte may review or edit the content of the Community Sites. Therefore, if you have concerns about any of the content of the Community Sites you should contact customer services. The relevant content may be removed from the Community Sites. If we believe that any material placed on the Community Sites by you is unlawful we may contact the relevant authority.

Opus Arte makes no representations as to the validity of any opinion, advice, information or statement displayed on the message boards by third parties. You are solely responsible for the content of your messages posted on the site and the views expressed by individuals do not represent the views of Opus Arte.

You will be responsible for:

  • any claim by any third party that the use of the Community Sites by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;
  • any claim by any third party that the use of the Community Sites by you infringes that third party's copyright or other intellectual property rights of whatever nature;
  • any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the Community Sites by you.

By submitting material you are granting Opus Arte a perpetual, royalty-free, non-exclusive licence to reproduce, modify, translate, make available, distribute and sublicense the material in whole or in part and in any form.

You will be responsible for our losses and costs resulting from your breach of these Community Sites terms and conditions.

5.) Intellectual Property and Licensing

(i) Intellectual Property

All music (streamed, downloaded or any other form of use or sample), software, text, images, graphics, user interfaces, videos, photographs, trademarks, logos, and artwork (collectively, "Content"), including but not limited to the design, selection, arrangement, and coordination of such Content on the Site is owned or licensed by or to Opus Arte, and is protected by copyright, trademark laws, and various other intellectual property rights laws. Except as expressly provided in these Terms of Use as amended from time to time, no part of the Site and no Content may be downloaded, copied, reproduced, recorded, broadcast, distributed, uploaded, posted, altered to make new works, performed, digitized, or transmitted in any way to any other computer, website or other medium or for any commercial purpose, without the prior express written consent of Opus Arte. You agree to indemnify and hold harmless Opus Arte for your failure to comply with this Section.

The content of the Opus Arte Site is protected by copyright, trademarks, database and other intellectual property rights. You may retrieve and display the content of the Opus Arte Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Opus Arte Site without written permission from Opus Arte.

(ii) Trademarks and Copyright

Please note that all material on Opus Arte website, including, but not limited to, design, text, graphics, logos, images, audio and video, is the property of Opus Arte and its affiliates, and may only be downloaded for your personal use. Any further distribution for sale or otherwise or use in any other manner is expressly prohibited. You are also prohibited from modifying, distributing, re-publishing, publicly performing or broadcasting any of the recordings, text, graphics or images included on this site without our express written consent.

Opus Arte provides this site and its contents on an "as is" basis and makes no representations, endorsements or warranties of any kind with respect to the site, its contents or any other site linked to this website. Neither Opus Arte nor any of its directors, employees or other representatives will be liable for any damages whatsoever arising out of or in connection with the use of this site, including, without limitation, damages for loss of use, data or profits, with delay or inability to use the site, the provision of or failure to provide services, or for any information, products, services and graphics obtained through the site or any linked site. Your sole and exclusive remedy is to discontinue using the site.

Album Cover Art. You may only access album cover art (to the extent available) for music for which you are the lawful owner of a legal copy. Album cover art is provided for personal, non-commercial use only. You agree that you will not use album cover art in any manner that would infringe or violate these Terms of Service or the rights of any other party, and that Opus Arte is not in any way responsible for any such use by you.

(iii) License to End User

For so long as the End User complies with these Terms of Use and providing this Agreement has not been terminated by either party in accordance with the Terms of Use, the End User is granted a sublicense to download such Content as shall be specifically offered by Opus Arte for download. Such content is sublicenced only and not sold, notwithstanding use of the terms "sell," "purchase," "order" or "buy" on the site or in this agreement. End Users do not obtain rights of ownership. The downloaded Content ("Digital Download") sublicense is a non-exclusive, non-transferable, and non-sublicensable licence to the End User for the End Users personal use. End Users may play their Digital Downloads an unlimited number of times on the same registered personal computer or any other secondary or portable device owned by the End User. For their own personal use, End User may "burn" their Digital Downloads from the Primary Computer to make permanent copies in an uncompressed form. Such copies may not be distributed in any way to any other individual or entity.

Except as otherwise provided End Users may not redigitize any Content or upload such Content to the Internet. End Users may not create any "derivative works" by altering any of the Content. End Users may not use the Content in conjunction with any other third-party content (e.g., to provide sound for a film) or otherwise exploit any such Content or for commercial purposes (including the sale of bundled Digital Downloads). End Users may not transfer or distribute Digital Downloads or Content. No uses other than personal uses are permitted.

End User shall promptly notify Opus Arte in writing upon any discovery of any unauthorized use or infringement of the Site or its Content or Opus Arte patent, copyright, trade secret, trademarks or other intellectual property rights.

6.) Product Information and Availability

Opus Arte reserves the right to change prices for Products offered at the Opus Arte Store at any time, and does not provide price protection or refunds in the event of a price drop or promotional offering. All recorded content in the Opus Arte store is subject to availability, whilst we make every effort to maintain the widest possible range of recordings, we reserve the right to withdraw titles from sale without notice. Whilst every effort is made to ensure the accuracy of the information displayed in the Opus Arte store, we cannot accept liability for any errors. We reserve the right to change information, specifications and descriptions of listed goods, products and services at any time without notice.

Some purchases you make shall be deemed performed in Guernsey. UK law shall govern every aspect of contractual agreement concerning purchases made from the Site.

7.) Limitations

You may not use the Opus Arte Site for any of the following purposes:

  • disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material
  • transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice
  • gaining unauthorised access to other computer systems
  • interfering with any other person's use or enjoyment of the Opus Arte Site
  • breaching any laws concerning the use of public telecommunications networks
  • interfering or disrupting networks or web sites connected to the Opus Arte Site
  • making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner

8.) Returns & Refunds

Opus Arte wants to ensure you are always happy with shopping at our site. To ensure this, we offer an "absolute satisfaction" guarantee where you can return any unopened item within 14 days of the date of dispatch from our warehouse. We will refund your credit/debit card in full once we have received and processed the item (please allow up to 14 days from date of postage). In order to make a return simply contact us . Please note that no returns can be made without first receiving a unique returns authorisation number from our customer care centre.

Please insert the reason for your return with the item, along with the invoice, and package securely. Please note, we recommend that you use recorded delivery or get a certificate of posting when returning goods, as we cannot be held responsible for goods lost on return to us.

Having obtained a returns reference number, please attach with the item to be returned the reason for your return, along with the invoice, and package the return securely Please note that Opus Arte can only refund postage costs where the return is a result of an error on our behalf or the unit is faulty.

Opus Arte will replace any faulty discs with the same title, or if the title is no longer available, will make refund back to the original credit card used in making the purchase. Please note that our returns policy is only valid for 28 days from receipt of goods.

Damaged Cases

If a CD jewel case is damaged when you receive it from us, we will be happy to mail you a replacement. Simply contact us .

Exchanges

Exchanges are only available on physical products (CD’s/DVD’s/Blu-ray) where the product received is faulty or the wrong item is received.

All purchases from the Opus Arte website are non-refundable. Due to the nature of the service you are not able to cancel any purchases of downloads after you have confirmed payment. Downloads may not be returned for any reason unless they are defective. Send it to us to check for corruption and if we are satisfied we will offer a full refund. In exceptional circumstances, refunds are given at the discretion of the management.

Testing

Opus Arte tests each item returned. If a returned item is found not to be faulty Opus Arte will return the item and will make a £1 charge for postage for discs and a charge not exceeding £5.00 for heavier non-disc items. Opus Arte advise you to check any disc on a separate player before returning to reduce any inconvenience. Regrettably, Opus Arte cannot be responsible for incompatibilities caused by machines that have been modified to disable regional encoding.

Problems and Questions

9.) Termination

Either Opus Arte or you may without prior notice terminate these Terms of Use for any reason at any time, with or without cause by providing notice to the End User at the contact email address specified by the End User from time to time if the termination is by Opus Arte or if the termination is by End User to customer services with the word "Termination" in the subject matter line, giving adequate personal details to Opus Arte to identify the End User. In the case of termination by Opus Arte upon notice of termination being sent (but not necessarily received) termination shall be effective and the End Users' right to use the Service shall immediately cease. In the case of a termination notice sent by End User, such notice shall be effective upon acknowledgement by Opus Arte that the termination notice has been received.

Termination of this Agreement shall not relieve the End User of any obligations to pay any outstanding amounts due, including but not limited to any prorated charges accrued for a billing cycle in which this Agreement is terminated.

Opus Arte may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.

You can cancel this agreement at any time by informing us in writing. If you do so, you must stop using the Opus Arte Site.

The suspension or cancellation of your registration and your right to use the Opus Arte Site shall not affect either party's rights or liabilities.

10.) International Use

Opus Arte makes no promise that materials on the Opus Arte Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Opus Arte Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

11.) Miscellaneous

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

If you breach these Terms and Conditions and Opus Arte ignores this, Opus Arte will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

Opus Arte shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.

A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.

12.) Disclaimer of Warranties and Limitation of Liability

End User agrees that Opus Arte will not be liable to End User or to any third party for termination of access to the Site.

End user understands that by using the site, end user may encounter content that may be deemed offensive, indecent, or objectionable, which content may or may not be identified as having explicit language. End user agrees to use the site at its sole risk and that Opus Arte shall have no liability to end user for content that may be found to be offensive, indecent, or objectionable.

Opus Arte does not make, and hereby disclaims, any representations or warranties regarding the site, the features, the content, products and services offered through the site or any portion thereof, express, implied or statutory, including (without limitation) implied warranties of merchantability, fitness for particular purpose, title, noninfringement of third party's right's or any warranties arising by course of dealing or custom of trade.

Opus Arte will make every effort to ensure that material, content, features and service displayed on or offered through the site correspond to description, are accurate, complete, appropriate, reliable, or timely.

Opus Arte reserves the right not to post or publish any materials, and to delete, remove or edit any material, at any time in its sole discretion without notice or liability. Opus Arte has the right, but not the obligation, to monitor any information and materials submitted or posted by end user or any other party or otherwise available on the site.

Opus Arte make no representations or warranties that the service will meet end users requirements and/or access to and use of the site will be uninterrupted or error-free, free of viruses, malicious code, or other harmful components or otherwise secure.

Opus Arte shall use reasonable efforts to protect information submitted to the end user in connection with the site, but end user acknowledges and agrees that the submission of such information is at its sole risk, and Opus Arte hereby disclaim any and all liability to you for any loss or liability relating to such information in any way.

To the maximum extent permitted by applicable law, neither Opus Arte, its officers, its directors, its employees, its licensors, suppliers, partners, affiliates or third-party service providers shall be liable to you or any third party for any direct, indirect, incidental, special, exemplary, punitive or consequential damages, or any other form of damages in any manner arising out of or in connection with this agreement or your use of the service, regardless of the form of action or the basis of the claim or whether or not Opus Arte has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of certain warranties. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations and exclusions may not apply to you.

In the event that any limitation of liability shall fail of its essential purpose, the maximum liability that Opus Arte shall have is limited to any amounts actually paid to Opus Arte by end user.

In opening an account, an End User agrees to indemnify and hold harmless Opus Arte, its Directors, Officers, Employees, Affiliates, Agents, Contractors, and Licensors with respect to any claims arising out of a breach of this agreement by the End User or by the use of the Site by the End User or any action taken by Opus Arte. This means that you cannot sue or recover any damages from Opus Arte, its Directors, Officers, Employees, Affiliates, Agents, Contractors, and Licensors.

13.) Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.
